1. Purpose and Scope

1.1 This document ("Annexe") forms an integral and binding part of the Terms and Conditions↗ of Happydemy®. It governs the methods, requirements, and consequences of User Digital Identification (hereinafter, "IDU") within the Happydemy® digital platform.

1.2 The IDU is a mandatory procedure to ensure the security, regulatory compliance, and integrity of the Happydemy® digital ecosystem, with particular reference to anti-money laundering (AML) regulations, electronic identification (eIDAS), and personal data protection (GDPR).

1.3 The IDU applies to all registered Users, regardless of their tax residence, profession, or nationality. Access to Platform services beyond the initial registration period is subject to the successful completion of the IDU.

2. Scope of Application

2.1 The IDU is mandatory for all Users. Access to the Platform by minors is expressly prohibited.

2.2 The registration of legal entities, professionals, or companies is not currently provided for. Should such categories be admitted in the future, this Annexe will apply in full, unless otherwise explicitly stated.

2.3 The Platform is accessible exclusively in the countries listed on the Authorised Countries↗ page. Access may be restricted or prohibited in territories subject to legal restrictions, international embargoes, or compliance measures imposed by competent authorities.

3. Account Status

3.1 On Happydemy®, a User's account exists in one of two states only:

  • Unverified (Guest Account): provides limited access to basic Platform features. The User cannot publish content, access the Creator Compensation Programme, or request payouts.

  • Verified Account: grants full access to all Platform features, including content publishing, social interaction, the Creator Compensation Programme, and payout eligibility. There are no tiers, levels, or intermediate verification states.

3.2 Verification is binary and unconditional. Once verified, the User retains full access to all Platform features with no additional steps, upgrades, or limits based on verification status alone.

4. Timing

4.1 Completion of the IDU is mandatory within 30 (thirty) days from the date of account registration, in accordance with Terms and Conditions Art. 4.7↗.

4.2 If the IDU is not completed within this deadline, the account will be suspended. All access to Platform services will be revoked, and the User will only be able to access the verification page until the process is completed.

4.3 Once completed, the IDU remains valid indefinitely, unless revoked by the Company due to suspected irregularities, discrepancies, or fraudulent conduct.

5. Verification Process

5.1 Identity verification is conducted exclusively through Happydemy®'s proprietary internal system, combining automated analysis and manual review by the Company's compliance team. No third-party services or external APIs are used at any stage of the verification process.

5.2 To complete the IDU, the User must provide:

  • A valid, government-issued identity document (passport, national ID card, or equivalent);

  • Full legal name, date of birth, and country of residence as they appear on the document.

5.3 Identity documents submitted for verification are permanently deleted from the Company's servers immediately upon completion of the verification decision. Only the verification outcome (verified / not verified) and the verification date are retained. No copies, traces, or backups are retained at any stage of the process.

5.4 Verification is free of charge for all Users.

6. Data Processing and Security

6.1 All data provided as part of the IDU is processed in compliance with Regulation (EU) 2016/679 (GDPR), the Irish Data Protection Act, and applicable national data protection law. Full details are available in the Privacy Policy↗.

6.2 No IDU data is used for marketing or profiling purposes. No data is sold or transferred to unauthorised third parties.

6.3 The User may check the status of their IDU at any time via the "Profile > Verification" section of their account on Happydemy Central.

7. Failure to Verify and False Declarations

7.1 Failure to complete the IDU within 30 days results in immediate account suspension, with no access to Platform services until the verification process is completed.

7.2 If the IDU is not completed within 12 (twelve) months from the registration date, the Company will notify the User at least twice before proceeding with permanent account termination, in accordance with Terms and Conditions Art. 4.8↗. Data and content will be retained and processed in accordance with the Privacy Policy↗ and mandatory data retention requirements.

7.3 In cases of false declarations, falsified documents, or fraudulent use of personal data, the Company will immediately and permanently deactivate the account without notice, freeze any HC balance in the Digital Wallet, and report the incident to the relevant national or international authorities, in accordance with Terms and Conditions Art. 4.7↗.

7.4 Identity verification may be revoked and re-verification required if suspicions, discrepancies, or irregularities arise after the initial verification is completed.

8. Updates and Language

8.1 This Annex may be updated by the Company at any time, for regulatory, technical, or operational reasons. Material changes take effect no earlier than 30 (thirty) days after publication. Minor or editorial changes take effect 7 (seven) days after publication.

8.2 This document is available in multiple languages as translations of the official English version. In the event of any discrepancy between language versions, the English version shall prevail, in accordance with Terms and Conditions Art. 13.4↗.
